1. WHO THESE TERMS ARE BETWEEN

These terms govern counselling services, online programmes and use of this website, provided by Ivana Budišin, independent clinical psychologist, practising as Luxembourg Psychology ("I", "the practice"), to you ("you", "the client").

Because this is a sole practice, "the practice" and "I" mean the same person throughout.

Booking a session or creating an account means you accept these terms.

2. WHAT WE PROVIDE

I provide psychological counselling — individual, couples and organisational — delivered in person in Luxembourg or online by video, in English and French.

What this is not. Counselling here is not psychiatric treatment, not a medical service, and does not include diagnosis of medical conditions or prescription of any medication or supplement. Where nutritional psychology is discussed, it is discussed as psychology: we do not prescribe diets, supplements or treatments, and we make no diagnostic claims.

If your needs fall outside what we can appropriately provide, we will say so and help you find the right service.

3. BOOKING AND PAYMENT

- Sessions are booked through this website or by direct arrangement.
- Every individual session is 50 minutes and €95.50. Fees for couples work and the online bundle are shown on the relevant booking page.
- The introductory call is 20 minutes and free of charge, with no obligation to book anything afterwards.
- Payment is due at booking, at the session, or on invoice.
- The price shown is the total amount you pay. All fees are in euros.

Sessions are not reimbursed by the Caisse nationale de santé (CNS) or by Luxembourg health insurance funds. Some private and international insurers reimburse psychological counselling — check with your insurer before booking. We can provide an invoice for that purpose on request.

4. CANCELLATION AND MISSED APPOINTMENTS

- You may cancel or reschedule free of charge up to 48 hours before your appointment.
- Cancellations made less than 48 hours before the appointment, and appointments you do not attend, are charged in full.
- If I have to cancel, you will be offered the next available slot or a full refund, whichever you prefer.
- I will always try to be reasonable where a genuine emergency prevents you attending. The policy exists so the time can be offered to someone else, not to penalise you for a difficult week.

5. YOUR RIGHT OF WITHDRAWAL

As a consumer buying a service online, you have a statutory right to withdraw within 14 days. Where you ask for a session to take place inside that period and it goes ahead, you lose the right of withdrawal for that session once it has been delivered — you will be asked to acknowledge this at booking.

6. CONFIDENTIALITY

Everything discussed in session is confidential and covered by professional secrecy, which for regulated health professionals in Luxembourg is a legal obligation and not merely a promise. The only exceptions are set out in section 5 of the Privacy Policy: serious and imminent risk to life, child or vulnerable-adult protection, and legal compulsion.

7. ONLINE SESSIONS

Online sessions run over Teams. You are responsible for joining from a private space with a stable connection. We are not liable for a session disrupted by your internet connection or device. If a technical failure on our side cuts a session short, we will reschedule the remaining time at no charge.

Please note the location you attend from: if you are outside Luxembourg, local rules may affect what we can lawfully provide.

8. THIS IS NOT AN EMERGENCY SERVICE

We hold no out-of-hours cover and do not monitor email, forms or the forum outside working hours.

9. ONLINE PROGRAMMES AND DIGITAL CONTENT

Free programmes are provided as-is, for general education. They are not personalised advice, do not create a client relationship, and are not a substitute for counselling. Programme content remains our intellectual property and is for your personal use only.

10. THE COMMUNITY FORUM

The forum is a peer space, moderated but not clinically supervised. Posts by other members are their views, not ours. Do not post information you would not want other members to read, and do not post another person's private information. We may remove content or suspend accounts where posts are abusive, harmful, or breach another person's privacy.

11. LIMITS OF LIABILITY

I provide counselling with reasonable professional skill and care in line with the standards of the profession in Luxembourg. Counselling outcomes cannot be guaranteed.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our liability is limited to the fees you have paid for the service concerned.

12. COMPLAINTS

Tell me first: email ivana@luxembourgpsychology.com and I will respond within ten working days. If that does not resolve it, you may raise the matter to the appropriate authority and the correct complaints body for psychologists in Luxembourg — or use the EU online dispute resolution platform at ec.europa.eu/consumers/odr

13. CHANGES, LAW AND JURISDICTION

We may update these terms; the version in force is the one published here when you book. These terms are governed by Luxembourg law, and the courts of Luxembourg have jurisdiction, without prejudice to any mandatory consumer right to bring proceedings in your own country of residence.

Under Article 37 GDPR a DPO is mandatory only where an organisation's core activity involves large-scale processing of special category data. A single-practitioner practice is not large scale. All data-protection enquiries go directly to the practitioner at the email above.

Payment card details are handled by our payment provider and are never stored by us.

2.3 When you attend counselling

Counselling notes describe your health. Under GDPR this is a special category of personal data and receives additional protection.

Data: Session notes, assessments, correspondence about your care
Purpose: Providing psychological counselling and continuity of care
Legal basis: Art. 9(2)(h) — provision of health care by a professional bound by professional secrecy, together with Art. 6(1)(b)

Data: Referral correspondence with your GP or specialist
Purpose: Coordinating your care, only where you have given written consent
Legal basis: Art. 9(2)(a) — your explicit consent

We never share clinical information with a doctor, employer, family member or anyone else without your specific, written, and freely given consent — except in the narrow circumstances described in section 5.

2.4 When you contact us, join a free programme, or subscribe

Every marketing email carries an unsubscribe link. Unsubscribing does not affect your counselling relationship in any way.

2.5 When you create a member account or post in the community forum

Data: Username, email, profile details, posts
Purpose: Running the members area and forum
Legal basis: Art. 6(1)(b) — performance of a contract

Anything you post in the forum is visible to other members. Please do not post information about your own health that you would not want other members to read.

3. WHO ELSE PROCESSES YOUR DATA

We use the following providers. Each acts on our instructions under a data processing agreement, and each is bound to protect your data.

Where a provider processes data outside the European Economic Area, that transfer is covered by European Commission Standard Contractual Clauses or an adequacy decision.

We do not sell your personal data. We never have and we never will.

4. HOW LONG WE KEEP IT

GDPR lets a controller state either a fixed period or the criteria used to decide it. Where the law prescribes no fixed number, the criteria are given instead — that is a complete answer, not an omission.

Retention: For as long as you are a client of this practice, and afterwards for the period that health professionals in Luxembourg are required to retain records. Where no fixed period is prescribed, records are kept only while there is a legitimate clinical or legal reason to keep them, and are then securely destroyed.

5. WHEN WE MAY HAVE TO BREAK CONFIDENTIALITY

Counselling is confidential. There are three narrow exceptions, and we will tell you whenever we can before acting:

1. Risk to life. Where there is a serious and imminent risk of harm to you or to another identifiable person.
2. Child or vulnerable-adult protection. Where we have reasonable grounds to believe a child or a vulnerable adult is at risk.
3. Legal compulsion. Where a court or a legally competent authority requires disclosure.

Outside these, nothing leaves the practice without your written consent.

6. YOUR RIGHTS

Under GDPR you have the right to:

- Access — get a copy of the personal data we hold about you
- Rectification — have inaccurate data corrected
- Erasure — have data deleted, where no legal or clinical obligation requires us to keep it
- Restriction — ask us to pause processing while a dispute is resolved
- Portability — receive your data in a machine-readable format
- Object — object to processing based on legitimate interests, and to direct marketing at any time
- Withdraw consent — at any time, without affecting anything done before you withdrew it

7. SECURITY

Data is stored on Wix's infrastructure, encrypted in transit over HTTPS. Access to clinical records is limited to the practitioner.

8. CHILDREN

Counselling for anyone under 18 requires the consent of a parent or legal guardian. We do not knowingly collect data from children through the website.

9. CHANGES TO THIS POLICY

We will update this page when our practices change, and revise the "last updated" date. If a change materially affects how your data is used, we will tell you directly.
